Re: Notice of Intent to Dedicate a Trust Water Right for In-stream Flow Purposes

This letter is being sent pursuant to Chapter 90.42.040(5) which requires that the Department of Ecology notify all appropriate state agencies, potentially affected local governments, federally recognized tribal governments, and other interested parties, prior to creating a trust water right.

Chehalis Power Generating, L.P. has filed an application to transfer Water Right Certificate No. 4088 permanently to the State of Washington Trust Water Rights Program. The certificate holder has specified that the water is to be transferred for instream flow purposes in the Chehalis River. The certificate holders have indicated that the water right has been perfected and beneficially used in the amount of 600 gallons per minute (gpm) and 52.46 acre-feet per year. The priority date of this use, and that of the proposed trust water right, is July 27, 1960.
