Ecology Department improves toxic-cleanup standards

OLYMPIA - The state Department of Ecology (Ecology) has adopted long-awaited changes to the state's standards and cleanup levels for toxic contamination.

The regulation signed this week makes the state's toxic-cleanup rules clearer and applies new scientific information to the cleanup standards.

The cleanup regulations were first adopted in 1991 to implement the Model Toxics Control Act (MTCA), which was passed by voters in 1988. The law created a program within Ecology dedicated to cleaning up air, soil and water that have been contaminated with toxins.

"The revised regulations took almost five years to complete due to extensive efforts to involve businesses, environmental groups, and the public," said Jim Pendowski, manager of the state's toxic-cleanup program. "The final regulation reflects a lot of thoughtful work aimed at blending scientific insight with practical application."

The amendments incorporate increased knowledge about how toxic chemicals react in the environment. The major changes to the amendments include:

The changes to the rule will take effect on Aug. 15. Ecology has elected to implement the revisions six months after adoption in order to develop the guidance necessary for effective use of the rule.

"This allows a transition phase, so all those affected by the changes -- both inside and outside of Ecology -- can understand and plan for differences in their site cleanups," said Pendowski.

During this period, Ecology will develop policies and guidance and train those responsible for instituting the amendments.

"As those doing the cleanups get more familiar with the revisions, it will be clear that the improvements simultaneously clarify the rule and give more flexibility in meeting state regulations," Pendowski added.
