Comes now Ralph E. Olson of OLSON ALTHAUSER LAWLER & SAMUELSON representing the property owners listed below and make this comment letter and notice that appeal will probably be taken from the Revised Mitigated Determination of Non-Significance dated July 3, 2002.
Objections to the Revised Mitigated Determination are set out as follows:
1 . The proposed project will increase flooding and probability of adverse impact on at least the following properties attached list as Exhibit A.
2 The Lead Agencies have not taken into consideration the accumulated impacts on the properties surrounding the project.
3. The Lead Agencies failed to require or present a full Drainage, Erosion and Control Plan.
4. The proposed plan violates the Thurston County Flood Control Ordinance TCC 14.38.050(A) as the plan substantially increased the flood risk to properties surrounding the project site.
5. The proposed plan violates the Thurston County Flood Control Ordinance TCC 14.38.050(C) in general and in specific will raise the level of the flood waters on properties surrounding the project site by more than one foot. All the properties noted in #1 above are within the one hundred (100) year flood plain.
